Terms Of Service
All articles of this Terms of Service are applicable unless specifically outlined within the final written agreement between Client and Artist. By contacting me for work you are hereby confirming you have read and understand and agree to the terms expressed below.
General
1. The commissioned artwork is for personal use only by default, if you wish to use the commission for commercial purposes please see the licensing section and contact me for a quote.2. Contact can be via email or instagram, whichever is more convenient for both parties.3. Average turnaround time will vary. Please discuss any deadlines with me when contacting me about your commission. Note that short notice/ fast turnaround could mean you incur an additional rush fee.4. I am only human and I can read wrong/make a mistake. Please look carefully over your commission to make sure I got everything right before final approval.5. If you wish to post the commission online, please ensure I am tagged where possible (@painandpaintings), my watermark is clearly visible and not cropped out and that you credit me (Pain & Paintings) in the title and/or caption.
Process
1. References must be provided before the commission starts. I can work from visual and/or written references. Include references with the correct outfit if applicable.2. Process pictures will be sent multiple times throughout the process, these will be sent via email or instagram, whichever is preferred.3. Anyone with a deposit paid will be contacted 1-2 weeks prior to work starting. If you fail to respond to this within 2 weeks, I will have to move onto the next person. Any delays to the completion date of your piece due to this are not the fault of the artist and a rush fee may be applied if you still want the art by the original deadline, subject to artists availability.4. Revisions can be made throughout the process. Please note that after the detailed sketch is approved, any revision requests for changes in pose, composition, added elements ect, will incur an extra charge.
pricing
1. The prices listed are base prices only. Please contact me with information on your project for an accurate custom quote. Complexity and other elements can alter the price.2. If you require a short turnaround time or to move up the deadline of a previously booked commission, you may be subject to a rush fee dependent on artist availability and the desired turn around time. Rush fee is +150%, (aka x2.5).
Payments
1. Payment via Paypal, in British Pound Sterling (GBP). Check your currency exchange rate here. All PayPal transactions are subject to the PayPal Privacy Policy.2. Do not send payments outside of invoice, unless it is a tip. Wait for the invoice.3. Payment will be made in 2 parts. Before the commission begins a 50% deposit is required, the commission can not be started until this is paid, unless arranged otherwise. The final 50% will be required upon approval of the final artwork but before any final, high quality files are sent.4. Payment plans can be arranged.5. Tips are very welcome! Cancellation And Refunds
1. You may cancel your commission at any time. If the cancellation is made more than 5 days prior to the work starting date, you will receive a full refund of your 50% deposit.2. If the project is cancelled within 5 days prior to Work Starting Date, or at any point prior to colouring and rendering, it is not possible for you to receive a refund of your 50% deposit. This is to cover resources and time taken during the project up to the point of cancellation.3. If the project is cancelled after colouring and rendering has begun, you are still required to pay the remaining 50% outstanding balance despite cancellation or postponement of the job.4. If I fail to complete a commission due to illness or other personal complications, a refund will be paid in full.
Personal Usage Rights
1. All rights and ownership of the artwork remain with the artist and you cannot alter, modify, distribute or use it for commercial nor advertising purposes unless agreed otherwise.2. The commissioned artwork is for personal use, promotion use and freebie use only. The work is for you to cherish, use as your social media avatar, put on your OC pages and print out and hang it up in your room, gift to a loved one, promote your project and for freebie merch. You cannot charge.3. Minor changes such as cropping or adding text are allowed. Do not edit or crop out my signature or watermark.4. Rights, licences and ownership can be purchased at additional cost.5. I may alter, modify and post the illustration on social media
